Practical Living
HOAs, Covenants, and Restrictions
Two homes on the same road can follow entirely different rules. Recorded documents, not marketing, determine what you can build and how you can use the property.
Documents to Request
- Declaration of covenants, conditions, and restrictions (CC&Rs) and amendments.
- Bylaws and current rules or architectural guidelines.
- Current budget, dues, special assessments, and reserve information.
- Recent meeting minutes.
- The recorded plat for the specific section.
Questions to Answer
- Is there architectural review, and what does it cover?
- Are outbuildings, fences, pools, or solar panels restricted?
- Are animals, including horses, permitted — and under what conditions?
- Are there minimum home sizes or approved-builder requirements?
- Are amenities owned by the association or by a separate entity?
